Artistiqhouse (“Artistiqhouse”, “we”, “us”, “our”) is committed to respecting intellectual property rights and providing a safe, transparent, and reliable NFT marketplace (the “Platform”). This Takedown Policy explains how to report and how we handle takedown requests regarding NFTs and related metadata, images, collection names, descriptions, user profiles, and other associated materials that are alleged to violate copyright, trademark rights, personality/publicity or reputation rights, applicable laws, or Platform rules.

1) Grounds for a Takedown Request

You may submit a takedown request if you believe one of the following applies:

  • An NFT, or any related element such as metadata, title, description, or collection name, infringes copyright, trademark rights, publicity/personality rights, or similar intellectual property rights.

  • The content is unlawful, misleading, intended for fraud, offensive/abusive, or otherwise violates applicable laws.

  • The content violates our Terms of Service, Community Guidelines, or other Platform policies.

2) How to Submit a Takedown Request

Subject line: “Takedown Request”

3) Required Information (Mandatory)

To help us review your request promptly, please include the following:

  • Your full name (or company name) and your relationship to the rights at issue (rights holder / authorized representative, etc.)

  • Your contact information (email and, if possible, phone number)

  • A clear description of the content you want removed, including direct URLs (NFT page, collection page, user profile, etc.)

  • The type of right you believe is being infringed and the basis for your claim (copyright, trademark, publicity/personality rights, etc.)

  • Evidence of ownership of the right or authorization to act (official website, registration/record number, link/file to the original work, power of attorney/authorization letter, etc.)

  • A good-faith statement that the use is not authorized by the rights holder, its agent, or the law

  • A statement that the information in the notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder

  • A wet-ink or electronic signature (typing your full name will be accepted as a signature)

If any of the above information is missing, we may be unable to process your request or may ask for additional details.

4) Review Process and Possible Actions

After receiving a complete request, Artistiqhouse may:

  • Remove the relevant content or disable access to it

  • Restrict the display of related images/previews/metadata

  • Limit, suspend, or terminate a user account in cases of repeated violations

  • Request additional documentation or information if necessary

We may retain relevant records for security, compliance, dispute resolution, and legal obligations.

5) Counter-Notice / Appeal (If You Believe the Removal Was a Mistake)

If you believe your content was removed in error, you may send an email to [email protected]
Subject line: “Counter-Notice”. Your counter-notice should include:

  • A description of the removed content and, if available, its URL

  • An explanation of why you believe the removal was mistaken

  • Any relevant license/permission documentation and supporting evidence

  • Your full name, contact information, and signature

Upon receiving a valid counter-notice, Artistiqhouse may, depending on the circumstances, reinstate the content or keep it disabled as required by applicable law, Platform policies, or an ongoing dispute resolution process.

6) Repeat Infringers

Artistiqhouse reserves the right to suspend or terminate accounts of users who are determined to be repeat infringers.

7) Abuse and Misrepresentations

False, misleading, or bad-faith takedown requests or counter-notices may result in legal liability and may lead to account-related actions on the Platform. If we determine that the process is being abused, we reserve the right to take appropriate action.
