TERMS & CONDITIONS
Welcome to the NFT marketplace operated by DLT Tech LLC (“Artistiqhouse”, “we”, “us”, “our”). These Terms of Use (“Agreement”) govern your access to and use of our website and any related services, software, or applications we provide (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by this Agreement in full. If you do not agree, you may not use the Platform.
IMPORTANT: This Agreement contains provisions that may affect your rights, including limitations of liability, a class action waiver, and dispute resolution terms.
1) Eligibility and Restricted Jurisdictions
You may use the Platform only if you are of legal age in your country of residence (for example, at least 18 years old) and have the legal capacity to enter into a binding contract. Individuals located in, established in, or citizens/residents of countries or regions subject to U.S., U.K., EU, or U.N. sanctions/embargoes/restrictions (“Restricted Jurisdictions”) may not use the Platform.
We may restrict access to the Platform in any jurisdictions we deem necessary.
2) Platform Use and Digital Wallets
To use certain features of the Platform, you must connect a non-custodial digital wallet that supports NFTs (a “Digital Wallet”). You are solely responsible for the security of your wallet credentials and the accuracy of your wallet address.
Artistiqhouse does not provide wallet services, does not access your private keys, and does not store private keys. We do not accept responsibility for risks related to Digital Wallet use, blockchain networks, or third-party wallet providers.
3) NFT Marketplace and Transactions
The Platform facilitates the listing and buying/selling of NFTs; however, we do not guarantee the quality, uniqueness, legality, authenticity, usability, or value of any NFT.
Blockchain transactions are generally irreversible. Transactions may not be cancellable after on-chain confirmation.
4) Prohibited Uses
You agree not to use the Platform to:

Violate applicable laws or AML/CTF obligations

Infringe intellectual property rights or sell counterfeit/unauthorized NFTs

Introduce malware, conduct DDoS attacks, scrape data, reverse engineer, or otherwise compromise Platform integrity

Misrepresent an affiliation with Artistiqhouse

Evade restrictions using VPNs, proxies, or similar tools

Use the Platform as a custodial or payment system without our written permission

Engage in fraud, deception, or abusive conduct
If we suspect a violation, we may take action including restricting, suspending, or terminating your account.
5) Registration and Profile
You may be required to register and provide accurate, current, and complete information. You are responsible for maintaining the security of your account and for all activity conducted through your account.
We may request additional verification, including KYC; and we may refuse, restrict, suspend, or terminate accounts.
6) Fees and Payments
You agree to pay all applicable fees, including Platform service fees and network (gas) fees related to NFT transactions. Where applicable, fees are displayed prior to transaction confirmation.
We are not responsible for gas fee fluctuations, network congestion, delays, or third-party payment issues.
7) Risks
Using NFTs and blockchain involves significant risks, including loss of value, security vulnerabilities, fraud, high volatility, and technical failures.
To the fullest extent permitted by law, we are not liable for smart contract/blockchain failures, forks/rollbacks/consensus changes, loss of private keys, loss of wallet access, regulatory changes, or third-party actions.
8) Intellectual Property (Platform Rights)
All software, trademarks, designs, content, and other elements of the Platform are owned by Artistiqhouse or its licensors (“Artistiqhouse IP”). You may not copy, reproduce, distribute, or use any Artistiqhouse IP without our written permission.
9) User Content and Listings
You represent and warrant that you have all necessary rights to any images, metadata, names, descriptions, and other content you provide (“User Content”), and that you have the authority to mint/list NFTs using such content.
By uploading User Content to the Platform, you grant Artistiqhouse a worldwide, non-exclusive, royalty-free license to host, display, and reproduce such User Content solely as necessary to operate, provide, and promote the Platform.
10) Third-Party Content
The Platform may contain links to third-party sites, services, or content. We are not responsible for issues arising from third parties. Your relationship with any third party is solely between you and that third party.
11) Payment Methods and Refunds
If purchases are made available via credit/debit cards or other methods, such transactions may be processed through third-party payment providers. Transactions may be delayed, rejected, or cancelled for technical, compliance, risk, or legal reasons.
Refunds are issued only in accordance with our Cancellation and Refund Policy.
12) Chargebacks and Refunds
If you initiate a chargeback/payment reversal, you agree to provide any information and documentation requested from us. Where applicable, we may require the NFT to be returned/transferred to an address we specify before processing any refund.
We reserve the right to dispute chargebacks, suspend accounts, and withhold funds to the extent permitted by payment network rules and applicable law.
13) Taxes
You are responsible for any tax obligations arising from your use of the Platform and your NFT/digital asset transactions. We do not provide tax advice.
14) Termination
We may suspend or terminate your access at any time, including where we suspect a violation of this Agreement or applicable law. Provisions that by their nature should survive termination will remain in effect.
15) Limitation of Liability
To the fullest extent permitted by law, Artistiqhouse is not liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenue, data, or goodwill.
To the fullest extent permitted by law, our total liability is limited to the greater of:
(a) the total fees you paid to Artistiqhouse (if any) in the six (6) months preceding the event giving rise to the claim, or
(b) USD 100.
Some jurisdictions may not allow these limitations.
16) Indemnification
You agree to indemnify and hold harmless Artistiqhouse from any claims, damages, losses, and liabilities arising out of your use of the Platform, your violation of this Agreement or applicable law, your dealings with third parties, or your User Content.
17) No Professional Advice
Nothing on the Platform constitutes legal, financial, tax, or investment advice. You should consult independent professionals before making decisions.
18) Dispute Resolution and Governing Law
This Agreement is governed by the laws of Albania, excluding conflict-of-law rules.
Disputes arising from this Agreement or the Platform shall be resolved in the competent courts of Tiranë, Albania, unless mandatory consumer protection laws require otherwise. We encourage you to contact us first to seek an amicable resolution.
19) Class Action Waiver
To the extent permitted by law, you agree to bring claims against Artistiqhouse only on an individual basis and not as a plaintiff or class member in any class, collective, or representative proceeding.
20) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, strikes, war, terrorism, regulatory changes, blockchain network failures, or third-party service disruptions.
21) Changes and Notices
We may modify this Agreement at any time. Continued use of the Platform after changes become effective constitutes acceptance. We may notify you of material changes via email or Platform announcements.
22) Entire Agreement and Severability
This Agreement, together with the Privacy Policy and any incorporated policies/terms, constitutes the entire agreement between you and Artistiqhouse. If any provision is held invalid, the remaining provisions remain in effect.
